This Privacy Policy applies to your use of our Sites in our role as Data Controller. Our Site may contain links to other websites. Please note that we have no control over how your data is collected, stored, or used by other websites and we advise you to check the privacy policies of any such websites before providing any data to them.

Section 16 of this Privacy Policy also covers our role as Data Processor on behalf of Our Clients.

  • Providing and managing your access to Our Site;
  • Supplying Our products services to you. Your personal details are required in order for us to enter into a contract with you.

Third Parties (including Google Analytics and Cloudflare) whose content appears on Our Site may use third-party Cookies, as detailed below in Part 14. Please refer to Part 14 for more information on controlling cookies. Please note that we do not control the activities of such third parties, nor the data that they collect and use themselves, and we advise you to check the privacy policies of any such third parties.

 

  1. How Long Will You Keep My Personal Data?

We will not keep your personal data for any longer than is necessary in light of the reason(s) for which it was first collected. Your personal data will therefore be kept for the following periods (or, where there is no fixed period, the following factors will be used to determine how long it is kept):

  • Where your contact via Our Site leads to your becoming a customer of ours we will retain your information for the duration of our business relationship and for a period following the termination of that relationship as dictated by UK Company Law, currently 7 years. This is to ensure that we can still contact you should any unforeseen need arise.
  • Where your contact via Our Site does not lead to your becoming a customer we will retain your personal data for no more than six months following our most recent communication, unless you provide your express permission for us to contact you at a later date.

 

  1. How and Where Do You Store or Transfer My Personal Data?

We may store or transfer some or all of your personal data in countries that are not part of the European Economic Area (the “EEA” consists of all EU member states, plus Norway, Iceland, and Liechtenstein). These are known as “third countries” and may not have data protection laws that are as strong as those in the UK and/or the EEA. This means that we will take additional steps in order to ensure that your personal data is treated just as safely and securely as it would be within the UK and under the GDPR as follows.

We use specific contracts with external third parties that are approved by the European Commission for the transfer of personal data to third countries. Where we transfer your data to a third party based in the US, this may be protected if they are part of the EU-US Privacy Shield. This requires that third party to provide data protection to standards similar to those in Europe. More information is available from the European Commission.

The security of your personal data is essential to us, and to protect your data, we take a number of important measures, including the following:

  • On and off-site encrypted backups
  • 2-factor authentications
  • Regular data access audits of employees and contractors
  • Company-wide access policies

 

 

  1. Do You Share My Personal Data?

We may sometimes contract with the following third parties to supply certain products or services. These may include payment processing, delivery, and marketing. In some cases, those third parties may require access to some or all of your personal data that we hold.

  • M247; based in UK; server and hosting provider.
  • Lemonbit; based in the Netherlands; server engineers. The team has secure access to our server to perform operating system and kernel updates, install security patches and backups.
  • Xero; based in UK; payment processing. Our finance and invoicing system stores your registered address and finance point of contact. This information is used to supply invoices. View the Xero privacy notice. 
  • Fastpay Ltd; based in UK; Direct Debit processor for some Clients that have elected to pay via this method.
  • GoCardless; based in UK; Direct Debit processor for some clients that have elected to pay via this method. All of its main processing (the processing of European payments) is carried out on servers that are located in the European Economic Area (EEA). GoCardless uses carefully chosen suppliers and providers to perform other discrete tasks which may result in data being transferred outside of the EEA.
  • Campaign Monitor; based in USA; for marketing purposes. Our email system which contains our email newsletter list of contacts who have requested to be kept up to date on our latest information.

If any of your personal data is required by a third party, as described above, we will take steps to ensure that your personal data is handled safely, securely, and in accordance with your rights, Our obligations, and the third party’s obligations under the law, as described above in Part 9.

If any personal data is transferred outside of the EEA, we will take suitable steps in order to ensure that your personal data is treated just as safely and securely as it would be within the UK and under the GDPR, as explained above in Part 9.

In some limited circumstances, we may be legally required to share certain personal data, which might include yours, if we are involved in legal proceedings or complying with legal obligations, a court order, or the instructions of a government authority.

 

  1. How Can I Control My Personal Data?

In addition to your rights under the GDPR, set out in Part 5, when you submit personal data via Our Site, you may be given options to restrict Our use of your personal data. In particular, we aim to give you strong controls on Our use of your data for direct marketing purposes (including the ability to opt-out of receiving emails from us which you may do by unsubscribing using the links provided in Our emails.).

There is not normally any charge for a subject access request. If your request is ‘manifestly unfounded or excessive’ (for example, if you make repetitive requests) a fee may be charged to cover Our administrative costs in responding.

We will respond to your subject access request within one month of receiving it. Normally, we aim to provide a complete response, including a copy of your personal data within that time. In some cases, however, particularly if your request is more complex, more time may be required up to a maximum of three months from the date we receive your request. You will be kept fully informed of Our progress.

  1. Personal Data managed by Our Clients

“Client” is the customer of Red Paint Multimedia Ltd. to whom We provide the various Services our business offers.

“Client Customer Data” is the Personal Data belonging the parties with whom our Client has a relationship. We have no direct relationship with the parties whose Client Customer Data is processed by our Clients.

Red Paint only acts as a data processor on behalf of Our Clients in the course of providing the Content Management System (CMS) used to manage the website. The Client must comply with legislation as a Data Controller and ensure that any data processing instructions it issues to Red Paint or via the CMS also comply.

Data processing of Client Customer Data in relation to hosting:

  • Client Customer Data collected on a Client’s website is stored within the European Economic Area (EEA)
  • Our hosting providers act as sub-processors who have their own processes that comply with GDPR. The main hosting providers used by Red Paint are M247 and AWS.
  • We shall not transfer any data outside the EU – our hosting data centres are located within the EU and backups of data are also stored within the EU
  • As part of Our hosting, we monitor the security of our servers and provide information on any security incident. Our server management company, acting as a sub-processor is Lemonbit.

If you are aware that your Personal Data has been provided to a Client of ours who has a Service with us, then please read this section of our Privacy Policy.

Our Clients use the Service to host, transmit or process data on our hosting platform and this, may include personal data of their own customers with whom they have a contractual relationship (Client Customer Data).

In this instance, it is Our Clients and not Us who define the process and policies by which Client Customer Data is collected and processed. We do not collect, view or share Client Customer Data except as outlined in the agreement We have in place with our Client to supply the Services, or as required by legislation. Nothing contained in this Privacy Policy shall alter specific terms and conditions applicable to the Service agreement.

Red Paint takes no responsibility in ensuring the GDPR compliance of a Client’s website, internal processes, online processes, content, terminology and terms and conditions. Each Client should seek legal advice to ensure they are fully compliant.

To find out how Client Customer Data is collected, stored and securely managed, and the process outlining how to gain access and/or to make changes, please refer to the Privacy Policy of the relevant Red Paint Client to whom you have provided your details or contact them directly. If you contact us with a request about your Client Customer Data (for example, you may no longer wish to be contacted by one of our Clients), We will pass on that request at the earliest opportunity.

We provide the Services directly to our Clients, and have no direct relationship with the parties whose Client Customer Data is processed by our Clients. Our customers take responsibility for all Client Customer Data that they process and for complying with relevant data protection legislation.

 

  1. Changes to this Privacy Policy

We may change this Privacy Notice from time to time. This may be necessary, for example, if the law changes, or if we change Our business in a way that affects personal data protection.

Any changes will be immediately posted on Our Site and you will be deemed to have accepted the terms of the Privacy Policy on your first use of Our Site following the alterations. We recommend that you check this page regularly to keep up-to-date.
